NOTICE OF SALE
BY VIRTUE OF A DECREE of the Court of Common Pleas for Georgetown County, South Carolina, heretofore issued in the above captioned action, I, the undersigned, as Special Referee for Georgetown County, South Carolina, will sell at public venue before the Courthouse doors at Georgetown, South Carolina, at 12:00 P.M. on Sales Day, November 3, 2014, the lands hereinafter described on the following terms: TO THE HIGHEST BIDDER, but before his bid is accepted, he will deposit with the Special Referee on his bid in cash or certified check, the sum of five (5%) percent of bid, to be deposited with the Special Referee immediately, with the balance to be remitted within thirty (30) days after the sales day (but this shall not apply to a bid placed by the Plaintiff), which shall include Interest at the rate of Seven and 75/100ths (7.75%) percent to be paid on balance of bid from date of sale to date of compliance. In the event the said purchaser(s) fail to comply with the terms of the sale within thirty (30) days, the Special Referee shall forthwith resell the property, after the due notice and advertisement, and shall continue to sell the same each subsequent sales day until a purchaser, who shall comply with the terms of sale shall be obtained, such sales to be made at the risk of the former purchaser. THE PROCEEDS OF SALE shall be applied to the costs allowed, and the debts found due and to other payments found due in the Final Order. THE PROPERTY is situate in Georgetown County, South Carolina, and is more particularly described as follows: All that certain piece, parcel or tract of land situate, lying and being in the City and County of Georgetown, State of South Carolina, known as Lot 12, South Island Plantation, Phase 1 as shown and designated on that certain plat entitled “SOUTH ISLAND PLANTATION PPD – PHASE 1 CITY OF GEORGETOWN, GEORGETOWN COUNTY, SOUTH CAROLINA FINAL PLAT” prepared for Winyah Bay Holdings, LLC, prepared by DDC Engineers dated July 14, 2005 and recorded in the RMC’s Office for Georgetown County on July 21, 2005 in Plat Slide 555 at Pages 1-5. This being the identical property conveyed to Hugh M. Smith by Deed of Winyah Bay Holdings, LLC dated August 25, 2005 and recorded on September 8, 2005 in the Office of the Register of Deeds for Georgetown County in Book 1699 at Page 120. TMS# 05-0055A-012-00-00 This conveyance is subject to all restrictions and taxes of record. The Grantee(s) assume(s) and agree(s) to observe and abide by all reservations and restrictions of record, easements, zoning ordinances, and rights of way of record, including those as set out on the aforesaid map. PURCHASER will pay for stamps and papers. Deficiency being demanded, the bidding shall remain open for thirty (30) days after Sales Day pursuant to SC Code Ann. Section 15-39-720 (1976, as amended).
