Under an Order of Sale for foreclosure issued December 12, 2016, on Complaint filed May 3, 2016, by Pawleys Place Homeowners Association, Inc., Plaintiff, against Kenneth Chad Kowalski, Defendant, Civil Action No. 2016-CP-22-00372, in the Court of Common Pleas for the 15th Judicial Circuit, Georgetown County, South Carolina. The Master will sell at public venue at the Courthouse in Georgetown, South Carolina, at 12:00 noon on Sales Day, Monday, April 3, 2017, the land herein described, on the following terms: To the highest bidder, but before his bid is accepted, he will deposit with the Master on his bid, in cash or certified check, the sum of Five percent (5%) of the bid, to be deposited with the Master immediately, with the balance to be remitted within thirty (30) days after Sales Day (but shall not apply to a bid placed by the Plaintiff). The successful bidder shall also pay interest at the rate of 7.5% on the bid amount from the date of bid to the date of compliance of bid. The proceeds of sale shall be applied to the costs allowed, and the debts found due; and any surplus funds shall be held pending further Order of this Court. This Property is situate in Georgetown County, South Carolina, and is more particularly described as follows: All and singular that certain piece, parcel or tract of land situate, lying and being in the Pawleys Island mainland area of the County of Georgetown, State of South Carolina, designated as Lot 2901 on a plat entitled “As-Built Survey of Building No. 29, Lots 2901, 2902, 2303, and 2904, at Phase 2 Pawleys Place for Portrait Homes – Myrtle Beach, L.L.C. located in Pawleys Island, Georgetown County, SC” prepared by ETS-Engineering and Technical Services, Inc., dated November 12, 2002, and recorded in the Office of the Register of Deeds for Georgetown County, South Carolina, in Plat Slide 446 at page 10. Said plat, which is specifically incorporated herein by reference, contains a more complete description as to the metes and bounds of the property. Together with a perpetual non-exclusive easement appurtenant to the above-described Lot for purposes of vehicular and pedestrian ingress and egress and over and across that certain roadway marked “Proposed 50’ Street Easement” on that certain plat prepared by ETS-Engineering and Technical Services, Inc., dated April 1, 1998, and recorded in the Office of the Register of Deeds for Georgetown County, South Carolina, in Plat Book S269 at Page 2. Together with a perpetual non-exclusive easement appurtenant to the above-described Lot for purposes of vehicular and pedestrian ingress and egress over and across those certain private drives as shown and depicted on a plat entitled “Site Plan of Pawleys Place at Village Green for Portrait Homes – Myrtle Beach, L.L.C., located in Pawleys Island, Georgetown County, prepared by ETS-Engineering and Technical Services, Inc., dated March 5, 1999, and recorded in the Office of the Register of Deeds for Georgetown County, South Carolina in Plat Book S303 at Page 4. Together with a perpetual non-exclusive easement appurtenant to the above-described Lot for purposes of vehicular and pedestrian ingress and egress over and across those certain private drives as shown and depicted on a plat entitled “Site Plan of Tract B, Pawleys Place at Village Green for Portrait Homes – Myrtle Beach, L.L.C., located in Pawleys Island, Georgetown County, prepared by ETS-Engineering and Technical Services, Inc., dated September 15, 2000, and recorded in the Office of the Register of Deeds for Georgetown County, South Carolina, in Plat Book S368 at Page 1. The aforesaid plats, which are specifically incorporated by reference, contain a more complete description as to the metes and bounds of the easement parcels. This conveyance shall be subject to all easements and encumbrances of record, specifically including, but not limited to, the Declaration of Covenants, Conditions and Restrictions for Pawleys Place, dated March 19, 1999, and recorded in the office of the Register of Deeds for Georgetown County, South Carolina, in Deed Book 960 at Page 1, Said Declaration being thereafter amended by the First Amendment to Declaration of Covenants, Conditions and Restrictions for Pawleys Place, dated September 14, 2000 and recorded in the office of the Register of Deeds for Georgetown County, South Carolina in Deed Book 1122 at page 294 and by Corrective Amendment dated October 24, 2000, and recorded in the office of the Register of Deeds for Georgetown County, South Carolina, in Deed Book 1128 at Page 31. This being the identical property conveyed to Kenneth Chad Kowalski by deed of Portrait Homes – Myrtle Beach, LLC n/k/a Portrait Homes – South Carolina, LLC, an Illinois Limited Liability Company, dated November 20, 2002 and recorded December 3, 2002 in the office of the Register of Deeds for Georgetown County, South Carolina in Deed Book 1334 at page 239. TMS# 4-153-2.29.01 Property Address: 90 Palisade Loop, Pawleys Island, SC 29585 This conveyance is made subject to all liens of record, including that certain mortgage in favor of Wachovia Bank, National Association n/k/a Wells Fargo Bank secured by the subject property, in the original amount of $10,000.00 maximum, dated October 1, 2004 and recorded October 13, 2004, in the Office of the Register of Deeds for Georgetown County, in Mortgage Book 2464 at Page 103. A Modification To Open-End Mortgage dated January 11, 2006 was recorded January 17, 2006 in the Georgetown County office of the Register of Deeds in Mortgage Book 2849 at Page 153. Said mortgage was subordinated to the J P Morgan Chase Bank, N.A. mortgage dated February 19, 2014 and recorded February 27, 2014 in the office of the Register of Deeds in Georgetown County in Mortgage Book 2320 at Page 35, by Subordination Agreement for Open-End Mortgage dated November 1, 2013 and recorded in the office of the Register of Deeds for Georgetown County on April 7, 2014 in Mortgage Book 2342 at Page 121, and that certain mortgage in favor of J P Morgan Chase Bank, N.A., secured by the subject property, in the original amount of $92,400.00, dated February 19, 2014 and recorded in the Office of the Register of Deeds for Georgetown County on February 27, 2014 in Mortgage Book 2320 at Page 35. Said mortgage was granted, sold, assigned, transferred and conveyed by J P Morgan Chase Bank, N.A. to Federal National Mortgage Association, its successor or assigns by South Carolina Assignment of Mortgage dated October 29, 2015 and recorded on March 21, 2016 in the office of the Register of Deeds for Georgetown County in Mortgage Book 2762 at Page 91. The Grantee assumes and agrees to observe and abide by all covenants, restrictions and reservations of record, taxes, easements, assessments, zoning ordinances, and rights of way of record. Purchaser will pay for deed preparation, deed stamps and the costs of recording said deed. Should the Plaintiff’s attorney fail to appear on Sales Day, the property shall not be sold, but shall be re-advertised and sold at some convenient Sales Day thereafter when the Plaintiff’s attorney is present. The Plaintiff does not warrantits title search to purchasers at foreclosure sale or to other third parties who are responsible for performing their own title search on the subject property. NOTICE: The foreclosure deed is not a warranty deed. interested bidders should satisfy themselves as to the quality of title to be conveyed by obtaining an independent title search prior to the foreclosure sale date.
