By virtue of the Order for Judgment of Foreclosure and Sale of The Honorable Benjamin H. Culbertson for Georgetown County, South Carolina, heretofore granted in the case of Habitat for Humanity Georgetown County, South Carolina, Inc. v. Ella Mae Gathers a/k/a Ella M. Gathers and Regional Finance CASE NO. 2017-CP-22-00374; I, the undersigned Master-in-Equity for Georgetown County, will sell on October 2, 2017 at 12:00 o’clock Noon, in Courtroom 2-C of the Georgetown County Judicial Center 401 Cleland Street, Georgetown, South Carolina, to the highest bidder, the following described property, to wit: ALL AND SINGULAR, that certain piece, parcel or lot of land in the City of Georgetown State of South Carolina shown and described as Parcel A, 0.12 Acre, 5,163 Sq. Ft. with improvements thereon, as delineated on the “Final Plat Showing a Division of a 0.24 Acre Lot on Hawkins Street Prepared for Habitat for Humanity,” dated July 23, 2007, prepared by Trico Engineering Consultants, Inc. and recorded in Plat Slide 650 at page 5B, records of the Register of Deeds for Georgetown County, South Carolina. SUBJECT TO, a perpetual and assignable easement of ingress and egress over and across Parcel A, 0.12 Acre, 5,163 Sq. Ft., said access easement being more fully shown and described as “Access Easement to Parcel B, 0.03 Acre, 1,417 Sq. Ft.,” as delineated on the “Final Plat Showing a Division of a 0.24 Acre Lot on Hawkins Street Prepared for Habitat for Humanity,” dated July 23, 2007, prepared by Trico Engineering Consultants, Inc. and recorded in Plat Slide 650 at page 5B, records of the Register of Deeds for Georgetown County, South Carolina. Said easement shall be appurtenant to and run with Parcel B. DERIVATION: This being a portion of the identical property conveyed to the Grantor herein by Title to Real Estate dated July 6, 2006 and recorded on July 6, 2006 in Record Book 94 at page 156, records of the Register of Deeds for Georgetown County, South Carolina. Property Address: 1908-A Hawkins Street, Georgetown, SC 29440 TERMS OF SALE: The successful bidder, other than the Plaintiff, will deposit with the Master-in-Equity at the conclusion of the bidding, Five (5%) per cent of the amount of bid (in cash or equivalent) as evidence of good faith, same to be applied on the purchase price only upon compliance with the bid, but in case of non-compliance within 30 days after the date of the sale, same to be forfeited and applied to costs and the property re-advertised for sale upon the same terms at the risk of the former highest bidder. The sale shall be subject to taxes, to existing easements and restrictions of record. The successful bidder will be required to pay interest on the bid from the date of sale to the date of compliance at the prevailing judgment interest rate. The Purchaser shall pay for the preparation of the Deed, transfer fees, and all costs of recording the deed. Attention is drawn to the Order for Judgment of Foreclosure and Sale on file with the Clerk of Court for Georgetown County, CASE NO. 2017-CP-22-00374. The terms and conditions of the actual Court Order, to the extent of any inconsistencies, control over any terms and conditions contained in this Notice of Sale. As deficiency judgment is being waived, the sale will be final. If the Plaintiff, or its representative does not appear at the scheduled sale of the above-described property, then this notice of sale and any attempted sale shall be null, void and of no force and effect and the sale of the above-referenced property will be postponed and rescheduled for the next available sales day.
